In February 2024 the European Court of Human Rights made a clear stand: deliberately undermining end-to-end encryption is unlawful.

Observers caution that negotiations risk becoming transactional rather than technical — countries could trade support on this file for concessions elsewhere — which is why public scrutiny and pressure remain crucial.
